BFO takes the privacy of its clients, partners and participants very seriously. BFO handles your personal data with great care, in accordance with the General Data Protection Regulation ("GDPR"). For that reason, we would like to explain our role and the way in which BFO collects and uses personal data.

What does BFO do?

All health clubs registered with BFO (hereinafter referred to as "partners") have outsourced their business (B2B) operations to BFO. These partners have instructed BFO to represent them in the formation of agreements with business clients (employers) as well as with "business members" (i.e. employees of the business clients) for purposes of a company fitness scheme. In addition, on the instructions of its partners, BFO may engage in promotional activities and arrange accounts receivable management.

BFO as processor

For purposes of its services, on the instructions and for the benefit of its partners, BFO uses only those personal data that are necessary to provide such services. In this data processing, BFO observes the instructions given by its partners. Since BFO comes under the express responsibility of the partners and uses the personal data of their business members on the instructions of its partners only, such partners are 'controllers' within the meaning of the GDPR. BFO, which uses the relevant personal data only for the benefit of the partners, thus qualifies as a 'processor' within the meaning of the GDPR. In accordance with its statutory obligations, BFO has entered into a data processing agreement with each partner.

The processing of personal data by each partner is subject to the privacy policy of the relevant partner. Therefore, we recommend that you carefully read that privacy policy as well!

BFO is processor on behalf of partners (health clubs); not on behalf of clients (employers)

Given BFO's role and responsibilities, BFO will not process any personal data on the instructions, for the benefit, or under the responsibility, of any employers or other clients. In other words: where BFO receives personal data from employers or other clients, it will use such personal data only for the partners on whose behalf which it acts. Therefore, in no event will BFO qualify as a processor vis-à-vis any employers or other business clients. Given this position of BFO, there is no statutory obligation for BFO to enter into a data processing agreement with any employers or other clients.

BFO as controller

In limited situations, BFO will act as an independent controller for the processing of personal data, for example in respect of personal data collected during your use of our website or if you contact us.

Which personal data do we process?

The term personal data comprises any data that can be traced back to an identifiable natural person. BFO can use those data to identify you, either directly or indirectly.

The personal data that we process about you, in our capacity as the controller, are as follows:

What do we do with your data?

BFO collects and uses your personal data for the purposes set forth below, each on a legal basis:

For the possible formation of an agreement: BFO collects and uses your personal data to provide the leaflet or information you request, to contact you for purposes of its services or to assess your job application. In addition, we will use your personal data to handle any requests, complaints or questions that you may have.

For our legitimate business interests: BFO uses your personal data to improve its services and to gain a better understanding of our website visitors, both on an aggregated and on an individual level, and to be able to better tailor our approach to their needs.
